Birthright Citizenship and the Debate Over Birth Tourism

By John Mullen

The Supreme Court recently reaffirmed the longstanding principle of birthright citizenship, ruling that children born in the United States to parents who are unlawfully or temporarily present are citizens under the Fourteenth Amendment.

In Trump v. Barbara, five justices agreed that the Constitution protects birthright citizenship in these circumstances, including Chief Justice John Roberts and Justice Amy Coney Barrett. The overall ruling was 6–3 because Justice Brett Kavanaugh agreed with the result on separate statutory grounds.

The Growth of Birth Tourism

The debate goes beyond undocumented immigration. Birth tourism involves foreign nationals traveling to the United States specifically to give birth so their children receive U.S. citizenship.

Critics argue that this practice can turn American citizenship into something that can be strategically obtained through a temporary visit. There have also been concerns about organized birth-tourism businesses that market U.S. births to foreign nationals, including customers from China.

The issue becomes even more complicated when surrogacy arrangements are involved, raising questions about citizenship, parental rights, and the purpose of birthright citizenship.

What Does American Citizenship Mean?

The Fourteenth Amendment's Citizenship Clause has provided the legal foundation for birthright citizenship for more than a century. The Supreme Court's recent decision reinforces that longstanding interpretation.

At the same time, Americans can reasonably debate whether birth tourism should be restricted and whether additional safeguards are necessary to prevent the commercial exploitation of U.S. citizenship.

Citizenship is one of America's most valuable privileges. The challenge is balancing the constitutional guarantee of birthright citizenship with legitimate concerns about immigration enforcement and organized birth tourism.

The debate over birthright citizenship is far from over, and Americans should continue discussing what citizenship means and how it should be protected.
